Pet Contracts
We offer Pet Contracts. If you would like a copy of our contract I will send you one via email. Contracts may vary according to the agreement between both parites. The following is a sample contract which can be modified at the time of purchase.
Buyer Agrees:
1. Buyer agrees to pay the Seller the sum of $ ___________ for the puppy ___________________.
2. The Buyer agrees that the sum above includes the AKC registration papers as a part of the price and understands the AKC papers will be sent once the check clears the bank. If paid in cash, the AKC registration papers will be given at the time of puppy for cash exchange.
3. The Buyer agrees to that the above does not include breeding rights to be sold with the dog unless otherwise agreed upon between both parties.
4. The Buyer agrees to have the puppy checked by a veterinarian within 7 days of purchase and should puppy be deemed to be unhealthy to forward proof to the breeder at which time steps may be taken to rectify if possible or a refund will be provided when the puppy is returned.
5. The Buyer agrees to provide the puppy with a good home environment (as opposed to a kennel) and to make every effort to keep the puppy in good health and condition.
6. The Buyer agrees to provide adequate medical attention to puppy when needed by a licensed veterinarian. We have a new policy concerning vaccinations. The new policy is that the new puppy owners are to read the book "What Vets Don't Tell You About Vaccines" by Catherine O'Driscoll. After reading the book, the new puppy owners can make their own educated decision as to which vaccinations they would like us to give the new puppy. The new owner also decides which vaccines they want to give for their puppy in the future. The new owner agrees to at least research and explore the possibility of Titer testing. After the first Rabies vaccination has been given to your dog, many counties will except titer testing as valid proof of rabies immunities, as opposed to continual rabies boosters which have been linked by studies that show them to be potentially harmful to some animals with certain medical conditions, such as allergies.
7. The Buyer agrees to spay / neuter the puppy before the puppy's first birthday and to forward proof of spaying / neutering to the Seller. If you have reservations in doing so, we are very willing to work with you on this important decision. We have provided some good links on the subject to help you make an educated decision.
8. The Buyer agrees to never tie or chain outdoors, but rather to provide either a fenced yard for the dog or to walk dog on a leash.
9. The Buyer agrees to contact the breeder should you decide not to keep the puppy.
10. The Buyer agrees that if flying in to pick up puppy in person, the fight cost will be the responsibility of the Buyer and the Seller is not responsible for the flight cost if the Buyer were to change their mind. The Seller agrees to meet the Buyer at the airport on the date given (if agreed upon as part of this contract). If the puppy is being shipped CARGO, the Buyer agrees to pick up the puppy at the airport on time.
11. The Buyer agrees that the puppy purchased herein must bear the kennel name CESPA as the first name in the AKC registration name and to list Cespa Tibetan Terriers as the secondary contact on the microchip information.
12. This contract will be signed & sent to Sharon Smith at 2130 SW 209th Ct. Aloha, OR 97006 along with a check in the amount agreed upon for purchase of the puppy. The AKC paperwork will be sent to the Buyer at the time the check clears the bank.
Buyer & Seller Agree:
This contract may be modified at anytime with the agreement of all parties whereto, but such modifications must be in writing. Any disputes relating to this contract shall be governed by the laws of the State of Oregon and all parties agree that this contract has been made in the State of Oregon for the purposes of determining jurisdiction should any litigation result from this contract.
Breeding Restrictions
Breeding restrictions apply to all the dogs we sell unless otherwise qualified and approved for a breeding program. This is the standard policy for most responsible breeders. Most standard contracts requires that you have your puppy spay & neuter before the age of one year old. This is to help motivate the new puppy owners to be responsible by spaying & neutering the dog. It also protects the dog &
prevents unwanted early pregnancies.
Breeding Rights
Breeding rights require a separate contract. We do not do co-owner contracts or dog trade agreements. If you are a breeder or plan on establishing a breeding program we would like to meet your first. We do not want our puppies to go to puppy farms. We microchip so we know where our puppies end up and we follow up. Contact us if you would like to view our breeding contracts. Otherwise breeding restrictions apply to
all the dogs we sell.
Show Contracts
Many of our puppies are show quality puppies but we do not do Show Contracts. We feel that it is up to the new owner if they want to show the dog or not. You may just want a "handsome dog" that you may, or may not want to show in the future. Our only requirement is that you use CESPA as the first name in the dog's registration papers.
Our Health Guarantee
We offer a One Year Health Guarantee. Our guarantee covers any major serious illness that is confirmed by a Vet within the first year. This guarantee is contingent on you making sure your puppy has Vet checks & proper care. It does not cover illness caused by negligence
of the new pet owners, such as a dog eating a toxic plant, poor diet related issues, etc. We do not sell puppies with know serious health problems. We want to know ASAP if a serious health problem occurs so we can determine if the disease is hereditary and if the Dam or Sire needs to be spay or neutered. If your dog becomes seriously ill within the first year and the illness is confirmed by your vet, you can return the dog for a new
puppy.
Referral
I prefer a referral from your current Vet when possible, but all are excepted.
Payment for Puppy
When meeting in person or at the airport is not an option...I do except checks & deposits. No money orders. There will be a clause in the contract stating that the AKC papers will not be sent until the check clears the bank. (3-4 weeks) Do you want the AKC registration papers now? Once you are approved for puppy adoption, I will give the AKC papers at the time of exchange, with
cash payment and the signing of the spay & neuter contract & Bill of Sale. We prefer you fly in to pick up your new puppy in person so there can be a straight forward even exchange which is designed to protect both parties. Read more at the bottom of this page.
Deposits for a "Pick" on Future Litters

I do take deposits on future litters once the dog is pregnant. It is a $250. non-refundable fee, unless otherwise specified. The order of pick is determined on a first deposit, first pick basis. If there is not a puppy you desire in the current litter, your deposit and pick will be placed towards the next litter. The deposits are set aside in a special account and applied at the time of puppy exchange.

Rescue Policy

Flying a Puppy
We prefer that you pick up the dog in person when possible. This is by far the best approach when buying an animal from someone you do not know. It protects all parties. We do ship puppies when necessary. You can come to my
house to meet us or I can meet you at the airport. It is the buyers' responsibility to purchase the flights and buy the pet carrier according to their airline's specifications. This can be done easily on line. They buyer is 100% responsible for any flight cost. The seller is not responsible for flight reimbursement if the buyer were to change their mind about purchasing a puppy. Once a confirmation of flight booking is received, I consider the puppy sold.
Flying a puppy as Cargo
We also can fly a puppy as cargo when necessary. And additional fee of $300.00 is required in advance. The cost includes the airline ticket of approximately $230.00-$250.00 plus the cost of the crate, blankets, water dishes, etc. We require this in advance because the flight has to be booked at our end. The airlines can not determine the total cost of shipping without the exact weight of the puppy &
crate. We pay anything over this amount if shipped within the US.
Your airline flight confirmation becomes like a security deposit to hold the puppy until you pick it up. As soon as I receive your airline confirmation, I consider the puppy SOLD.
Once I approve you, I do a all inclusive exchange for CASH.

Payment of Puppy with Checks
I also sell dogs with deposits and take checks when necessary. I take checks under contract and I wait for the check to clear before you receive your AKC registration papers. Breeders get scammed as much, if not more, than buyers. I do not do money orders because many doing fraudulent dog deals use forged money orders in their practice because they are more difficult to track.
Beware of puppy scams.
WARNING....Puppy Scam Con Artist have been stealing CESPA pictures and using them for puppy scams on all of the Puppy For Sale Sites. If you come across any CESPA pictures being used for puppy scams, please email me immediately, so together we can we can report them to the Fraud Department. All of our CESPA images have a copy right and unauthorized use of our pictures is illegal.
Do not fall for a scam! These are tips to look for:
Most Puppy Scam Con Artist will post a puppy for $300.00 to $500.00 on the "Puppy For Sale" sites like Puppy Find, Well Bred Dogs, Next Day Pets, etc. Many will say..."Includes Shipping". Shipping alone, cost around $300.00. So is the dog free??? They will even include Vet Checks, Shots, etc. Just the vet checks and immunizations can cost more that what they are asking for the puppy. Be smart. Learn to ask all the right questions.
Many Scam Artist will also use bad English and grammar in their emails with you. That should be an instant warning. When asked for their information, many will send you photo copies stolen IDs. When asked why their address information does not match the ID, they will tell you stories like "We are in the Military", etc.
If you suspect fraud, ask them if you can fly in to see their facility and pick up the puppy in person. Tell them that you insist in meeting the parents of the puppies and see how the dogs are raised. They will either suddenly stop emailing you or try to come up with reasons and stories why they can't. Most will NOT have web sites and they use pictures they steal off of the web from other breeders. These pictures are often sent once you begin email conversations with them.
Puppy Find has a "Report a Puppy Scam" button....push it!
If you suspect fraud, ask for the AKC Registration Numbers on both parents. Many people are getting the dog but never receive the papers AKC papers for the dog because the breeder does not own the breeding rights to the animal. You can do this research on the AKC web site using the Dam & Sire's AKC number at: http://k9ped.com/tibetan.html
Google the Breeder's name to see if there are any reports of scams against the breeder. You will be surprised what you can discover.
Ask for the OFA Hip Certification Numbers. You can research and confirm the results yourself by going to the OFA web site at: WWW.offa.org Testing a dog's hips in not a requirement. A OFA Hip Certification is no guarantee that your dog will not have hip issues,
but it is a great preventative measure. With eye exams the Doctor can tell you immediately if your dog passed or failed. The actual certificates are sent at a later date. You can check out a dog's pedigree for hip & health problems and learn more about the testing of dogs by visiting:

Beware of Breeders saying "send you papers later" without a contract. There are spay & neuter contracts that are necessary & legitimate. They help prevent homeless animals and un-planned breeding's from occurring. Many breeders do not send the papers until proof of the surgery has taken place. That is great as long as you have a contract to protect yourself. If you do not
have a contract, you may never see your AKC papers. Without papers you can not show a dog or do agility with the dog.
If you have been scammed, report it. Report it to all the puppy for sale sites and to the AKC. Make sure you have proof of the scam or you can be sued for slander.
Does the breeder have a Web Site? Some reputable breeders do not have web sites and that is ok. A web site is not a requirement, but most puppy scammers do NOT have web sites. Make sure the breeders are forthright with all their contact information. Yellow Book their name and make sure it is a match to what they are telling you. You can also google map them to see more. Most
puppy scammers do not want to establish a public presence on line. Some are bold enough to try, but selling a puppy that the breeder claims can be AKC registered and it can not be, is a crime. It is theft by deception. The more up front the information you receive, the better. Next Day Pets offers a ID Verification
process. Ask for this. Next Day Pets does this ID Verification check using a national database to verify that you are who you say you are. It only takes the breeders a few minutes of the breeder's time and only cost $5.00. So why not.... if you are who you say you are?
How can you spot a PUPPY FARM?
Ask the breeders how many different breeds of dogs they sell. It is ok to sell more than one breed, just do a complete check if they sell several breeds of dogs and make sure the facility is being ran to your standards. You can also ask how many breeding pairs of each breed they sell. If it is one or two that is good. The more types of breeds
they sell, the more they are inclined to be a puppy farm, but that is not always the case. Puppy farms will usually have multiple listings posted on line with several different types of dogs. Paying less for a dog is not worth supporting the horrible conditions of a puppy farm. If you suspect this, ask if you can come view their facility. They will not want to show it to you.
Beware of the terminology Lifetime Health Guarantee. Dogs are like people. It is impossible to predict what disease a new born baby will get when they turn 60 years old. Impossible. There is no such thing as a Life Time Health Guarantee. I feel this is misleading terminology. That is like a politician saying "I will never raise your taxes". The best a breeder can
do is to research the health history for their line of dogs, do the health certifications, give shots, and take the dog & new puppies to the vet for examinations. The guarantee part, is usually a promise of a different puppy, or a refund which is perfectly reasonable. The guarantee is usually contingent on the return of the sick dog and proof of disease by a Vet. They do not include miss-treatment to the animal, improper diet related issues, a dog eating a
toxic plant...etc.
Dog Breeder Ethics
Buying a puppy is a two way process. We want to know about you and you may have questions for us.
Questions you may want to ask your Breeder and Why.
Ask your Breeder: "What is the FULL AKC name (if not provided via web site) of both parents and what are the dog's AKC registration numbers?" ... and "Has this litter been AKC registured?"
WHY? Many dogs are being sold under false pretense and can not be registered by the AKC because the Breeder does not have breeding rights to the dog. The buyer gets the dog, but never see the papers. Some dogs are sold without papers which is ok as long as they buyer is aware of the fact. The Breeder should give out this information freely. Once you have this important
information you can do a search on the Sire & Dam. It is worth the time to protect yourself. Besides, it is fun to see the Pedigree of the dog you are getting ready to buy. Once you have the name of the Dam & Sire you can do a Pedigree Search at:
What is the age of the Dam?
WHY? Most think that it is not ethical to breed a dog before her third heat or until she is close to, or over 2 years old. Anything under the age of 18 months is considered too young to breed a Dam and even cruel by most. A Pre-Hip test can be done if the Dam goes into heat a couple of months before the age of two. OFA Hip Certifications can not be done until the age of 2
years old. The age of the Dam can affect both the puppies and the Dam's health. You can also use the Pedigree Search for this information.
Can I have copies of the dog's OFA Hip & Eye Certificates?
Get a copy of the OFA hip records or ask for the Certification # of both the Sire and the Dam if they claim to have them. All you need is the Number on the OFA Hip Certificate to do a search. WHY? If they are not being open or honest about this information then run! If they lie about this, they may be lying about other things as well. Many claim to have these documents, but
do not give them out because they do not have them. The breeder may have done the tests are waiting for the results. The vet doing the test can give his evaluation, but the official results are sent in the mail and take time. If the line is free from hip problems, these test may not be of great importance. Some breeds do not have the hip problems and other breeds might have a very long history of hip problems.
Does the dog come with Vet Checks?
WHY? Once again ask for a copy of these documents because they may be forged. Do not stop there. If you suspect that they are not legitimate, then call the Vet on the documents and ask if this puppy has been seen. Make sure you give the name of the Dam, because most vets put the puppy's information on the Dam's chart. If a dog is being shipped then it will need and OFFICIAL
CERTIFICATE OF VETERINARY INSPECTION. If the dog is over three months old, the airlines will require a Rabies vaccination. You will also need legitimate vaccination documents before your dog can be groomed.
Can we meet both the Sire and the Dam?
WHY? Because many, but not all, traits are passed down by the parents. (Some traits are due to up-bringing) You can tell allot by meeting the parents of the puppies. If the breeder is not willing to do this then you need to ask yourself why not. Some breeders will only let you see the puppies, but I feel that meeting both the Sire and Dam are important. There have been
stories of people buying a puppy that had "fear biting" issues, only to find out that the Dam or Sire had fear biting issues.
Can we see the home or kennel where the dogs are raised? Do they raise them in their house? In the bedroom? In the barn? In the family room? In an outside kennel?
WHY? This can be a sign as to how well the puppies will be socialized when you get them. You can also get a good feel for how they run their breeding program. But be polite. Make an appointment.
Does the puppy come with a vaccination record?
WHY? Because some breeders claim to have given the puppies the first set of shots, but you never receive a copy of the shot record. They could be lying plus you would have no way of knowing exactly which vaccinations were given. Do not take someone's word on this. Get the records! It is important to keep your puppy on a schedule when giving these important vaccinations and
you need a copy to give your vet so the vet knows exactly which vaccination was used. He may want to include some that were not in the original set of shots. Every area has different high risk diseases.
Does your breeder give you a Health Guarantee?
Some do not & if that is ok with you, then buy the puppy. WHY? Serious Health problems that arise within the first year SHOULD be of GREAT concern to a breeder, and a health policy is a reflection of concern. The breeder needs to know about any serious problems that arise to protect the integrity of their breeding program. These health guarantees do not cover the neglect
of the owner, accidental injury, nutritional problems, etc. Only hereditary health problems.
How many litters have they had over the years? Do they breed their dogs on every single heat cycle?
WHY? Breeding a dog in excess is cruel. Simple as that. If they are breeding a dog every single heat cycle, without a break now and then, it is a reflection of character and priorities. Their priority should be the Dam's health and the health of the puppies.
Here are some tough ones for the breeder!!!
Do you love and adore your dogs? Do you consider your dogs breeding stock or are they your pets and part of your family? Do you keep your Dams when you are done breeding them, or find homes for them? If you do not like the quality of the puppies the dam produces, do you find her a new home or keep her as a valued member of your family? If your Dogs do not do well in the show ring,
do you keep them or find pet homes for them?
These things may not seem of great concern when buying a puppy and that is ok. It is a matter of what is important to you and what you support.
There is a fine line between trying to help "improve the Pedigree" of the dogs and treating animals as if they are expendible live stock. Finding pet homes is NOT necessarily a bad thing, (Especially of a dog has special needs that the owner can't meet) ... but if it is common practice for a breeder to do this over and over and over again, then you have to ask: "Are their dogs really
part of the family as they say they are?" Are the dogs only valued as much as their ability to produce the perfect puppy? Does their breeding program reflect the love of the breed or something other? True motive is always found in one's actions, not in one's words.
More about Us
Here are answers to some of my own questions. We adore our dogs and we love sharing the gift of a puppy to those who will love them as much as we do. We consider our dogs as part of our family. We plan on keeping our dogs forever. (The only exception would be is if we ended up with two Alpha dogs that fought and injury was a huge concern). We feel that letting our dogs play
and have fun is a priority over spending hours excessive grooming that the dogs do not necessarily enjoy, so we prefer puppy cuts. We may choose to show our dogs one day, but showing is not our main focus. Our goal is to provide happy, beautiful, healthy puppies for others to enjoy. Our dogs are the love of our life and they know it.
Yes, we give Health Guarantees, Vet checks, copies of Certificates, vaccination records, full AKC registration, and we let everyone come to meet our dogs. We include Microchips to help aid in animal rescue. We do not breed our dogs too often. Our puppies are born in a bedroom next to ours and remain there until the age of 4 to 5 weeks. Then we move them to our family room where
they are kept until they leave to join their new family.
We consider our puppies to be "precious spirit beings" and love each and every one of them. TTs are our passion first, our business second.
